PLEASE SCROLL DOWN AND READ THESE TERMS OF USE BEFORE USING THIS WEBSITE OR ANY OTHER MEDIABUZZ CHANNEL, SERVICE, OR PRODUCT. By agreeing to these Terms, you agree to resolve all disputes through binding individual arbitration, which means that you waive any right to have those disputes decided by a judge or jury, and that you waive your right to participate in class actions, class arbitrations, or representative actions.

  1. Mediabuzz.asia and other MediaBUZZ websites (collectively, the “Website”) are digital services owned and operated by MediaBUZZ Pte Ltd (“MediaBUZZ”, “our” or “we”). The Terms of Use also apply to other MediaBUZZ operated digital services and channels, including without limitation our mobile site, applications, digital membership products, print or online magazine subscriptions, events, social media and various services, including information, communications, links, software, newsletters, products, services, other materials, and any and all other services that may be added, offered or provided to you from time to time through the Website.
  2. The Website and any Services provided on the Website are not intended for persons resident in the European Union. By accessing or using the Website, you agree to be legally bound by these Terms of Use.
  3. The Terms of Use may be revised or updated from time to time. The revised or updated Terms of Use will be posted on the Website and your continued use of the Website shall be deemed and construed as your conclusive and binding acceptance of the revision and updated terms.
  4. In addition, Services added, offered, or provided to you through the Website, may be subject to additional guidelines and rules. In such an event, all such guidelines and rules shall be deemed incorporated in the Terms of Use by reference. MediaBUZZ may also offer other services that are governed by different terms of use. Your use of the Website and/or Services tells us you have read and agreed to these Terms of Use. These Terms are a binding contract between you and MediaBUZZ regarding your use of the Website and Services, unless a different set of terms of service is set out on a specific site or service, in which case these Terms will supplement the applicable set of terms of use. MediaBUZZ‘s subscriptions, surveys, contests, and events may have additional terms and conditions that supplement these terms. If you do not agree with any of these terms, please stop using the Website and cease your use of any MediaBUZZ Services.

  1. All Services and the Website are provided on an “AS IS WHERE IS” basis. MediaBUZZ makes no representation or warranty, whether express or implied: (a) as to the use, accuracy, reliability, non-infringement, satisfactory quality, security, or fitness for any particular purpose of the Website; or (b) that the use of the Website will be uninterrupted and free of any computer viruses and/or software bugs.

In no event shall MediaBUZZ or any of its affiliates or related companies be liable for any loss, injury, damage, claims, costs, or expense of any kind arising from any error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus or other harmful elements, communication line failure, breach of contract, tort, negligence, defamation, copyright infringement, breach of intellectual property right or any other cause of action.

Contents and materials on the Website are the exclusive property of MediaBUZZ and/or the content suppliers. You may use the Website, Services, and Content online and solely for your personal, non-commercial use, and you may download or print a single copy of any portion of the Content, where permitted, for your personal, non-commercial use, provided you do not remove any trademark, copyright or other notice contained in such Content. You may not copy, reproduce, distribute, republish, repost, modify, transmit, make available to the public, adapt, create a derivative work, or otherwise use or exploit any content on the Website in any way or for any purpose without the express written permission of MediaBUZZ or its content suppliers. No Marks may be used in any manner unless approved in advance, in writing by MediaBUZZ.

MediaBUZZ may provide facilities on the Website to permit you to submit your contribution (including but not limited to any text, graphics, video and/or audio content, and other materials or information) (“Submissions“) to MediaBUZZ or to the Website directly. You are solely responsible for your own Submissions, and MediaBUZZ only acts as a passive conduit for the online distribution and publication of your Submissions.
  4. By submitting your Submissions, you agree as follows:-
    1. you will not include any content in your Submissions that is or could be unlawful, defamatory, offensive, obscene, dangerous or false, or any content that is protected by copyright or other intellectual property right, without first obtaining permission of the copyright owner or rights-holder, or any content that contains any viruses, bugs or other harmful elements;
    2. you hereby grant to MediaBUZZ a perpetual, worldwide, irrevocable, non-exclusive, royalty-free and sub-licensable right and license to use and exercise all copyright and publicity rights you have in your Submissions in any media and for any purpose; and
    3. you will not assume a false identity or the identity of another user when using the Website, and you will not use the Website for any unlawful or illegal activities, including but not limited to spamming, harassing or otherwise causing distress to other users.
  1. MediaBUZZ has the right, but not obligation, to monitor the Submissions contributed to the Website. MediaBUZZ shall have the right to remove or delete any material that MediaBUZZ, in its sole discretion, finds to be in violation of these terms or otherwise objectionable or inappropriate without having to assign any reason. In addition, MediaBUZZ shall have the right to terminate your use of the Website if it believes that you have violated these terms or for any other reason whatsoever, without notice to you.
  2. If you submit or provide any personal data through the Website, you acknowledge and agree that your personal data will be collected, used, disclosed and/or processed by MediaBUZZ for the following purposes:
    • For MediaBUZZ or its designated representatives or business partners to provide goods and services to you or parties designated by you and matters ancillary thereto.
    • To verify and process payment when you purchase goods and services from MediaBUZZ.
    • For verification and record of your personal particulars including comparing it with information from other sources and using the information to communicate with you.
    • For research and analysis, including surveys and polls.
    • To send you notices, information, promotions and updates including marketing and advertising materials in relation to MediaBUZZ’s goods and services and those of third-party organizations selected by MediaBUZZ.
    • To comply with any request from any third party or any order of court or directive from authorities investigating any alleged offence or misconduct or for the purposes of taking legal action against you.
  1. By agreeing to the Terms of Use, you:
    1. Consent to MediaBUZZ collecting, using, disclosing and/or processing your personal data for the purposes as described in Clause 13 above.
    2. Consent to MediaBUZZ transferring your personal data out of Singapore to MediaBUZZ’s third party service providers or agents for the purposes as described in Clause 13 above.

Venue

  1. Where you subscribe for any services on the Website that relates to any advertisement or other similar services, whether as a potential seller or buyer, you hereby expressly acknowledge and agree that the Website acts as a venue and MediaBUZZ is not responsible for the reliability, accuracy or truthfulness of any information that is posted by other contributors.

Indemnity

  1. You agree to defend and hold MediaBUZZ, its affiliates and related corporations from and against all claims, losses, damages, costs, and expenses, including legal fees on an indemnity basis, arising out of your use of the Website or any breach of the terms. In addition, MediaBUZZ may use whatever information that is available about you to stop any such breach or any unlawful or inappropriate use of the Website, including informing any third party MediaBUZZ deems appropriate.
  2. If any of the terms is held to be invalid or unenforceable, such term shall be struck out and the remaining terms shall be enforced. Any failure to act by MediaBUZZ with respect to any breach by you or others of any of the provisions of the Terms of Use does not waive MediaBUZZ’s right to act with respect to subsequent or similar breaches.

Notice

  1. You hereby agree and acknowledge:-
    1. that all electronic communications made pursuant to the use of the Website shall be given legal effect, validity and enforceability and shall have, between the parties thereto, comparable evidential value to that accorded to a signed written document; and
    2. not to contest the legally binding nature, validity, or enforceability of any transaction on the Site on the ground that it was entered into electronically.

Governing Laws

  1. The Terms of Use shall be governed by Singapore laws and any dispute arising out of the use of the Website shall be referred to the Singapore courts.
